1. Agreement to Terms

By accessing or using the SiteStamp platform ("Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you may not use the Service. These Terms apply to all users, including administrators, employees, supervisors and subcontractors who access the platform through a company account.

2. Description of Service

SiteStamp is a cloud-based construction management platform that provides tools for timesheet tracking, daily logs, drawing & RFI management, submittals, change orders, certified payroll reporting (WH-347), ADP paydata export, cost code management and QuickBooks integration. The Service is offered on a subscription basis with multiple plan tiers.

3. Account Registration

To use the Service you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use at robert@sitestamp.us.

4. Subscriptions & Payment

Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe. By subscribing you authorize us to charge your payment method at the start of each billing cycle. All fees are quoted in US Dollars and are non-refundable except as described in our Refund & Cancellation Policy.

We reserve the right to change pricing with 30 days' written notice. Existing subscribers will be notified via email before any price change takes effect.

5. Free Trial

We may offer a free trial period. At the end of the trial your account will automatically convert to the selected paid plan unless you cancel before the trial ends. You will not be charged during the trial period.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose.
Attempt to gain unauthorized access to any part of the Service.
Transmit viruses, malware or other harmful code.
Reverse-engineer, decompile or disassemble any part of the platform.
Resell or sublicense the Service without our written consent.

7. Intellectual Property

All content, features, branding and technology comprising the Service are owned by SiteStamp and protected by copyright, trademark and other intellectual property laws. Your data remains your property; by using the Service you grant us a limited license to store, process and display your data solely to provide the Service.

8. Data & Privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Service you consent to such processing.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITESTAMP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

11. Termination

We may suspend or terminate your access if you violate these Terms. Upon termination your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification and governing law survive termination.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in New York County, New York.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
